Terms of Service

1. The agreement

These terms are an agreement between the business that opens an account (the "hotel", "you") and Radiant Horizons Hospitality Pvt Ltd ("HOBO", "we"), for the use of the HOBO Enterprise platform at hoboenterprise.in and its related apps and APIs. By creating an account or using the platform you accept them. If you accept for a company, you confirm you may bind that company.

2. The service

HOBO Enterprise is a property-management platform: bookings and stays, front-desk operations, guest records, messaging, invoicing, reports, connections to booking channels and payment providers, and optional modules such as Competitive Analysis and Ads. Features may be added, changed or retired; we will not remove a capability material to you mid-subscription without reasonable notice.

3. Accounts and staff

Keep your account information accurate and your credentials safe. You decide which of your staff get access and with what permissions, and you are responsible for what they do on the platform. Tell us promptly at Akshit@hobostays.in if you suspect unauthorised access.

4. Your data and your guests

Data you enter or sync stays yours. You are responsible for collecting and using your guests' data lawfully — telling guests what you collect, having a lawful basis, and honouring their requests. We process guest data on your behalf, as described in the Privacy Policy, and we help you honour deletion requests.

5. Connected services

Google, Meta, WhatsApp, channel managers, payment providers and booking sites connect through your own accounts with those services, under their terms, which you must follow. We act on your instructions within what each connection allows. You can disconnect any of them at any time inside the platform, which removes our access tokens.

6. Advertising features

Advertisements created through the platform run in your own ad accounts and spend your own budgets. Nothing is published without a person on your side telling the platform to publish it. You are responsible for the content of your advertisements and their compliance with the ad platforms' policies and the law. Predictions, scores and estimates shown by the platform are estimates, not promises of performance.

7. Competitive information

The Competitive Analysis module shows publicly available information about other hotels — prices, ratings, reviews, public advertisements — collected from public sources. It is provided as-is for benchmarking; we do not guarantee its accuracy or completeness, and you must use it in compliance with the law.

8. Fees

Paid plans, modules and usage-based charges are as agreed with us in writing or shown inside the platform, plus applicable taxes (such as GST). Usage-based features stop when their prepaid balance runs out; nothing already on your screens is taken away. Fees already paid are non-refundable except where the law says otherwise or we agree otherwise.

9. Acceptable use

• No unlawful, infringing or deceptive content or use.
• No attempts to break, probe or overload the platform's security or other tenants' data.
• No reselling or white-labelling the platform without a written agreement.
• No use of the platform to send spam or messages the recipient has not agreed to receive.

10. Availability

We work to keep the platform available and give notice of planned maintenance where practical, but it is provided "as is", and outages of connected third parties (booking sites, Google, Meta, payment providers) are outside our control.

11. Intellectual property

The platform, its software and its design remain ours. Your data remains yours; you give us only the licence needed to host and process it to run the service for you.

12. Ending the agreement

You can stop using the platform and close your account at any time. We may suspend or end an account that seriously or repeatedly breaks these terms, after notice where reasonable. On closure you can ask for an export of your data; afterwards we delete it as described on the Data Deletion page, keeping only what the law requires.

13. Liability

To the extent the law allows: we are not liable for indirect or consequential losses, or loss of profits, revenue or data; and our total liability for claims arising out of the service in any 12 months is limited to the fees you paid us for the service in those 12 months. Nothing limits liability that cannot be limited by law.

14. Law and disputes

These terms are governed by the laws of India, and the courts at New Delhi, India have exclusive jurisdiction. If a dispute arises, write to us first at Akshit@hobostays.in — most issues are resolved by talking.

15. Changes

We may update these terms; the date above changes when we do, and material changes are announced inside the platform or by email before they take effect. Using the platform after that means you accept the updated terms.
